    Why Trademark Renewal?

    Trademark means a mark capable of being represented graphically and which is capable of distinguishing the goods or services of one person from those of others in the market. It may include the shape of goods, their packaging and combination of colours. Trademark registration can be obtained for a business name, distinctive catch phrases, taglines, captions and logos whatever helps your business or product standout from those of others in the market. Registration gives the trademark owner the exclusive right to use the mark with respect to his/her goods or services.

    The registration of a trademark is valid for a period of 10 years from the date of application. After which, it can be renewed from time to time. Trademark renewal can be done within 6 months before the date of the expiry of the Trademark Registration. The Trademark Department sends a notice to intimate about the trademark renewal before the date of expiry. If not renewed before the expiry of the Trademark registration period, a trademark renewal can be done within 12 months from the date of expiry of the Trademark registration on the payment of additional fees to the department. Trademark renewal preserves those rights which are only available to a registered Trademark. In case the owner fails to renew the trademark, then the trademark is bound to be removed and he will lose all the protection that comes along with registration.

    Trademark Renewal Process

    Prepare the Trademark Renewal Application in Form TM-R. The Trademark Renewal Application can be filed by the owner or his/her authorized agent.

    Once the Trademark Renewal Application is prepared, the same is to be signed by the owner or his/her authorized agent.

    After signing the Trademark Renewal Application shall be filed with the department upon payment of requisite fees.

    Once the Trademark Renewal Application is filed with the department, it is processed normally within 7-10 days and the details of the Trademark Renewed is published in the weekly Trademark Journal. However, the time may vary as per the pendency with the department.
